Two men facing charges related to a double murder earlier this month just north of downtown were back in court Wednesday morning. All 3 suspects remain in custody.
A Douglas County judge says there's not enough evidence to hold 18-year-old Warren Anderson and 17-year-old Martin Anderson on conspiracy charges but there is enough for an accessory charge.
Police responded to the shooting at the Ernie Chambers Court Apartments at 16th & Yates St. on December 9th. They found James Star and Brandon Phelps, both teens, dead inside an SUV.
Wednesday, an investigator testified that after a probation officer came forward and identified the shooter as 15-year-old Courvoisier Sims. They tracked his juvenile probation ankle bracelet that put him at the scene of the murders.
Investigators say Sims knew the victims from Blackburn High School and that he told the cousins he was buying a gun from Star for $150. They warned him the price sounded like a robbery set-up, and Sims apparently said he was prepared. The Andersons told authorities they didn't see Sims shoot the teens, but drove him from the scene. Sims allegedly gave them his own gun and one he had taken from Star.
"We're confident there was evidence about a gun being involved, either a transaction taking place to get a gun or somebody to rip somebody off or something to that extent but we certainly know what the end result was here and that's two people dead,” said Douglas County Attorney Don Kleine.
Warren Anderson is being held at the county jail on $1 million bond. The other two are at the Douglas County Youth Center.
There's no word yet on if the Andersons' bonds will be reduced because the more serious conspiracy charge was dismissed.
The SUV the victims were located in was allegedly used in another 2015 homicide, but police say they were not involved with that murder.
