After a shooting last week that killed 44-year-old Jason Davis and critically injured 30-year-old Justin Huskey, Huskey's 5-year-old daughter is now in foster care.
According to an affidavit, Omaha Police officers found marijuana out in the open in Huskey's home, which was the site of the fatal shooting. They also found two handguns and a loaded shotgun that police said would have been accessible to his daughter.
Officers also found a digital scale, a money counter, butane torches and glass pipes, all items common for the use or sale of marijuana, according to police.
Officers concluded marijuana was being sold in the home and the drugs and firearms were a significant danger to the child.
According to state law, a protective custody hearing must be within two weeks after a child is removed from a home. A hearing regarding Huskey's daughter is scheduled
Huskey was released from the hospital Tuesday and has not been charged with any crimes.
