In a ruling handed down Tuesday afternoon, Judge Gary Randall found Alison Motta's recent public comments in the case violated ethical rules and interfered with the administration of justice in the case. The court determined that in the interest to ensure fairness in the upcoming trial, the court determined that Alison Motta can no longer participate as a counsel of record in the case.

Alison Motta will be allowed to assist the defense to any extent that any non-lawyer could, but the court will not allow her to have a speaking role in the trial or sit at the defense table,

Robert Motta, Jr. and Robert Motta, Sr. will be allowed to remain as Garcia's defense attorneys, along with the new Nebraska lawyers who joined the case this week.
