BREAKING: Garcia competent for death penalty phase

Convicted Creighton killer Anthony Garcia's death penalty hearing will move forward later this week.
 
Judge Gary Randall orders that Anthony Garcia is competent to have a death penalty hearing on Thursday. He's convicted of killing Thomas Hunter and Shirlee Sherman in 2008 and Dr. Roger and Mary Brumback in 2013 as revenge for being fired from the Creighton pathology department.
 
This is the 3rd time he was sent to the Lincoln Regional Center for an evaluation. His defense says he hasn't spoken to them since before trial. He also refused to show up for his most recent hearings, or answer Judge Randall's questions. "The judge said this has been five months since this hearing was set in effect and it's kind of a last minute presentation by the defense to have this done, and said this has already been determined and we're not going to stop here 2 days before the hearing" said Douglas County Attorney Don Kleine. 
 
Doctor Klaus Hartman determined quote "his behaviors appear contrived, calculated and self serving."
 
The judge went as far as to call this a "Hail Mary" attempt to stop the hearing. So the three-judge panel for the death penalty hearing will take place on Thursday.
