COUNCIL BLUFFS, Iowa (KMTV) — The case of a fatal shooting in Council Bluffs over the weekend will be heard by a Grand Jury to determine if 67-year-old Stephen Hahn will face charges. It was determined a Grand Jury was needed Monday after police consulted with Pottawatamie County attorney Matt Wilber.
According to a police release, officers found 59-year-old Russ Atkins dead in the street Sunday afternoon. Following an investigation, it was determined Stephen Hahn attempted to intervene with a domestic violence disturbance involving Atkins and a female. During the altercation between Hahn and Atkins, Hahn fired one shot, killing Atkins. Hahn is legally able to carry a firearm.
Police say Hahn knew Atkins and the woman involved and that a protection order existed between Atkins and the female.
