DCSO: Nelson will not be charged for homicide

Douglas County officials said Brenda Nelson will not be charged for homicide in the lawnmower crash. 

On May 19th, Sheriff' Officials said Nelson was driving northbound on 261st Street near Pacific in Waterloo when she hit Donald Fitzwater on his John Deere lawnmower in the road.

Fitzwater died from his injuries.

Officials said there was an insufficient evidence to show that Nelson's intoxication was the cause of Fitzwater's death. 

Nelson will be cited for driving under the influence and first offense.

She will appear in the Douglas County Court at a later time.
