Scotty Payne, a former Omaha Police officer involved in the death of Zachary Bearheels, will stand trial.
Payne is charged with one count of felony assault after using his stun gun a dozen times on Bearheels.
During a Monday hearing, another Omaha Police officer testified that Payne's use of the stun gun was unjustified.
There is no word on when his trial will begin.
