OPD Detective theorizes Brumback murder

In the case against Anthony Garcia prosecutors lay out a detailed account of how Garcia was tracked down after the Brumbacks were murdered in May 2013, and how a possible murder weapon was found.

Detective Derek Mois testifies for the third time and talked about how he believes Roger Brumback was shot opening his door.  Prosecutors introduced demonstrative renderings of the scenario Friday in Douglas County District Court.

Detective Mois says it took about two weeks after the Brumbacks were murdered to key on Garcia.  His investigation took him through Creighton Pathology Dept. records plus bank, phone, and vehicle records.

Garcia’s arrested in July 2013.  In September 2014, still without a potential murder weapon, Mois testified they inquired through a national database.  Turns out part of a weapon Garcia purchased in March 2013 was located off an interstate exit in Illinois a year prior.  That weapon is found without a magazine and barrel.  The prosecution pointed out a magazine and recoil spring were found at the Brumback scene.

The defense went after Mois’ theory of how Brumback was shot.  Mois said they didn’t take evidence from the door even though Brumback could’ve been shot in front of it since there was no blood visible.  Defense Attorney Bob Motta Jr. questioned the trajectory of the bullet because Mois’ theory showed an upward trajectory when the bullet went through Brumback in a downward trajectory.

Motta questioned why other persons of interest weren’t further investigated, and the theory on the Dundee murders.

He brought out a photo of Garcia’s silver Honda CRV and showed it to Det. Mois, who pointed out the distinct spare tire on the back.  Motta argued that none of the Dundee witnesses mentioned a spare tire on the CRV they saw.

The prosecution rebutted by saying the paper trail clearly shows the likelihood that Garcia went to the Bewtra home first and tripped an alarm, went to Wing Stop on 72nd & Pacific St., and then murdered the Brumbacks.   Det. Mois agreed with the prosecution that there was a clear motive because Dr. Hunter and Dr. Brumback were writing references to other medical offices about Garcia’s Creighton termination.
