A financially troubled Omaha wine shop that abruptly closed - stunning workers and customers earlier this year - is now in a court battle with a big bank.
Mutual of Omaha filed a lawsuit against the entity and Daniel Matuszek, the owner of Brix, after he closed the stores in both Midtown Crossing and Village Point in January.
The bank filed a motion last month for the assets of only Brixco's Village Pointe location after Brixco missed payment due on a $1 million loan issued in 2010 to the company. The bank argued they were entitled to whatever was inside the restaurant in order to recoup their investment.
A judge signed an order Monday saying everything inside the Village Pointe location is property of the bank.
