A shooting near 21st and Martha killed 39-year-old Aristea Pena-Robles Tuesday morning and was declared a homicide by Omaha Police.

A release from OPD Tuesday afternoon stated Shawn Stewart, 34, will be booked for second-degree murder, use of a gun to commit a felony, felon in possession of a firearm and possession of a controlled substance.

According to Lt. Steve Cerveny, officers arrived at the scene a little after 3 a.m. where they found a Pena-Robles and several others inside a house.

Investigators believe the Pena-Robles knew the people in the house, living there temporarily to help with a re-model, police say.

The Pena-Robles had a gunshot wound in his upper body and medics rushed him CUMC-Bergan Mercy Hospital, where he later died.
