OMAHA, Neb. (KMTV) — A ruling in the City of Omaha's trial against the Yale Park Landlord appears to be a win for Kay Anderson.
A judge ruled a search warrant used to inspect the complex last year was invalid, which means the evidence of the code violations collected cannot be used in court.
Our partners at the Omaha World-Herald report that Anderson's trial scheduled for tomorrow is being delayed as the City appeals the judge's ruling.
The judge said the City never tried to obtain Anderson's consent to inspect the property.
Anderson is charged with 94 misdemeanors.
